The Return Of U.S. Menu Labeling Regulations

The FDA has announced that food operators have until November 7th, 2023 to meet menu labeling requirements again after being on pause due to the Covid public health crisis that officially ended in May.

What To Know

Restaurant chains with 20 or more locations must provide calorie information on menus, menu boards, and other point-of-sale materials and make all other nutritional information available in writing upon customer request. Food operators were encouraged to comply with menu-labeling rules throughout the coronavirus health crisis but did not enforce the requirements.

 

The Cost Of Non-Compliance

If the calorie and other nutrition information is not accurate, the foods would be considered misbranded and subject to the same penalties that misbranded packaged foods are subject to under the FD&C Act. Fines of up to $750,000 are possible for businesses that are out of compliance.
